Divorce Related Real Estate Transactions are complicated when people are married, but add divorce and it becomes very complicated. When people marry, they rarely think about it ending in divorce, but unfortunately, it happens very often. Divorce is tricky, it is emotional, it is hard on everyone, and it is difficult to get through it and come out on the other side, but one simple thing can go a long long way and help you to close out this chapter of your life with dignity and move on to your next…communication.
I have assisted many clients in this position. The best outcomes for parties all had one thing in common, a form of open communication to get through it all. Here are some things to consider doing if you find yourself in this situation.
First, set boundaries. This is an important step and can keep things from going off the rails when the emotion comes into it. Decide how and how often you will communicate, twice a week? Via email? Phone? By establishing boundaries early on you’ll avoid a lot of unpleasantness down the road.
Consider your tone and how you come across before emailing, calling, or talking in person however you and your spouse have decided to communicate. Pausing and considering how the other side is going to receive what you have to say can help you to curtail any sarcasm or mimicking tones that will only serve to upset your spouse.
Stay focused on important issues. It’s easy to get sidetracked and forget what the actual issue your discussing is and start piling on blame or arguing about other things, try not to do this. Try instead to think about your final outcome and getting there as easily and painlessly as possible.
And finally, use a mediator, a professional mediator will be impartial and will be able to dissect the issues without all of the emotion to help you come to a resolution. It’s never easy to go through a divorce, but good communication definitely goes a long way in easing the burden in a Divorce Related Real Estate Transaction.
